PROPOSED RECALL CAMPAIGN OF ST. LOUIS CITY

MAYOR FRANCIS SLAY

Article III, Section 2 of the Charter requires a Recall Petition directed at a citywide elected official to be signed by at least twenty percent (20%) of the registered voters in the City of St. Louis, at the time of the last preceding regular mayoral election, and include the signatures of at least (20%) of the registered voters at that time in each of at least two-thirds (2/3) of the wards in the city.

Points of Concern

No length of time for petitioning, except that the petitions are submitted at least six (6) months prior to his next election, March 2009, therefore that month would be September, 2008.

Sample wording of petition is attached, election board personnel willing to review for approval, legal advice recommended.

People who actually gather signatures DO NOT have to be registered voters of the city; although those who sign the petition must be registered voters in the city.

Petitions must be turned in as a whole and the board will certify within ten (10) days. During this period the petitions are available for public review and can be purchased. The mayor will be notified once they have been officially filed. During this time, those who signed can be encouraged to withdraw their signatures through an affidavit. If our number of petitions falls short, we will have twenty (20) days to supplement the number. If the Recall Petition (with supplements, if any) is found to contain sufficient signatures of registered voters, a certification to that effect will be mailed to the Recall Target, together with a cover letter advising him/her that, if he/she does not resign his/her position within ten (10) calendar days after the date of such mailing, the Board will submit the question of his/her recall to the appropriate voters at the first election at which it may lawfully be submitted.
